Heard learned counsel for the parties.
Petitioner is husband of the ex-employee who died in harness on 23 April 2018.
By the instant petition, petitioner seeks the following relief:
"a) Issue, a writ order or direction in the nature of mandamus, directing the respondent authorities to pay the General Provident Fund (GPF), Insurance and other retiral benefits."
Learned Standing Counsel submits that the second respondent pass appropriate order on the representation of the petitioner in accordance with law.
In view thereof, on consent, the petition is disposed of directing the second respondent, Chief Medical Officer, Moradabad, to consider and decide the representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within three months from the date of filing of certified copy of this order along with the copy of the writ petition. Failing which, petitioner shall be entitled to interest at the rate of 6.5% on the entire sum from the due date.
It is clarified that the Court has not considered the claim of the petitioner on merits.
