Heard Sri K.C. Vishwakarma, Advocate holding brief of Sri Narendra Kumar, learned counsel appearing for the petitioner and Sri Prateek Sinha, learned counsel appearing for the State- respondents.
Petitioner seeks a direction to the respondent-Municipal Commissioner, Nagar Mahapalika, Kanpur Nagar, to consider the application for allotment of a shop at Loha Bazar, Parade Market, Ghasiyari Mandi, Hatiya Maniram Bagiya Complex, Kanpur Nagar, under the Scheme of "Displaced Shop Keepers".
It is urged that petitioner had deposited requisite fee for allotment of a new shop in lieu of the old shop, however, his application is pending decision.
Learned counsel appearing for the respondent-Nagar Nigam submits that application of the petitioner shall be considered by the second respondent within time frame.
In regard thereto, writ petition, by consent, stands disposed of directing the second respondent-Municipal Commissioner, Nagar Mahapalika, Kanpur Nagar, to consider and decide the application of the petitioner by a reasoned and speaking order in accordance with law expeditiously, preferably within a period of six weeks from the date of filing of certified copy of this order along with copy of the writ petition and annexures thereto.
It is made clear that the Court has not considered the claim and contention of the petitioner on merit.
