ORDER:
This Civil Revision Petition is filed feeling aggrieved by non-grant of ad-interim injunction, and instead, granting of issue of notice to the respondents, by the learned VIII Additional Senior Civil Judge, Ranga Reddy District, at L.B.Nagar, Hyderabad.
This Court by order, dated 01.10.2014, while issuing notice to the respondents directed that they shall not disconnect water and electricity to the suit schedule flat.
I have heard learned counsel for both parties.
Keeping aside the aspect whether a Revision under Article 227 of the Constitution of India is maintainable, in the absence of an order of rejection of ad-interim injunction, this Court would like the lower Court to dispose of I.A.No.1086 of 2014 in O.S.No.1509 of 2014 on merits, after hearing both sides.
Accordingly, the learned VIII Additional Senior Civil Judge, Ranga Reddy District, at L.B.Nagar, Hyderabad is directed to dispose of I.A.No.1086 of 2014 in O.S.No.1509 of 2014, after hearing both parties, within a period of two months from the date of receipt of a copy of the order. Till such disposal, the respondents shall continue water and electricity supplies to the petitioner’s flat.
The Civil Revision Petition is, accordingly, disposed of.
As a sequel to disposal of the Civil Revision Petition, CRPMP.No.4743 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
