Petitioner has come up in this writ petition against the recovery citation dated 23.10.2018 for a sum of Rs.1,23,221/- plus others for recovering the electricity dues.
Learned counsel for the petitioner admits that the petitioner is using electricity connection since 23.02.2011 and that till date he has not made payment of any bill, in fact no bill has been raised against him.
Since, the petitioner accepts that he has been using electricity since 2011 and has not paid any electricity dues it is clear that he is liable to make the payment of the electricity as consumed and all ancillary amounts.
In view of above only for the reason that no demand before issuing the recovery was served upon him, we do not feel inclined to interfere in the matter in exercise of extraordinary jurisdiction.
Learned counsel for the petitioner at this stage submits that the petitioner may be allowed to pay amount in installments. If that be so the petitioner may approach the Executive Engineer for fixing installments.
The Executive Engineer under Section 6.14 of the Electricity Code is the Competent Authority to fix installments.
Accordingly, the Writ Petition is disposed of.
