1. Called in revise. None appeared to press this revision. In the circumstances, I myself have perused the record.
2. This criminal revision under Section 397/401 Cr.P.C., has been filed aggrieved by the judgment dated 12.12.1997 passed by IInd Additional Sessions Judge, Moradabad. The IVth Additional Munsif Magistrate, Moradabad vide judgment dated 02.09.1996 passed in Criminal Case No. 256 of 191994 convicted revisionist and sentenced to undergo three months rigorous imprisonment under Section 279 IPC, 18 months rigorous imprisonment under Section 338 IPC, one year rigorous imprisonment under Section 427 IPC and two years rigorous imprisonment under Section 304-A IPC. Thereagainst, revisionist preferred Criminal Appeal No. 32 of 1996 and Appellate Court dismissed the appeal with modification that revisionist shall undergo sentence of two years rigorous imprisonment under Section 304-A IPC as the revisionist has been sentenced under major offence. Being aggrieved the revisionist preferred present revision.
3. Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.
4. Dismissed. Interim order, if any, stands vacated.
5. Certify this judgment to the lower Court immediately.
