Heard learned counsel for the petitioner, learned A.G.A. for the State and Sri Baleshwar Chatruvedi, learned counsel for the Power Corporation.
This writ petition has been filed by the petitioner with the prayer to quash the F. I. R. dated 26.02.2018 lodged in Case Crime No.17 of 2018, under Section 135 of Electricity Act, Police Station Gohan, District Jalaun.
It is contended by learned counsel for the petitioner that the petitioner is ready to deposit the compounding charges before the Power Corporation.
After hearing the learned counsel for the petitioner, learned A.G.A. and after perusing the averments made in the present petition, no useful purpose would be served in keeping the petition pending which is being finally disposed of with the direction that in case, the petitioner deposits the entire amount due to be paid by him before the concerned authority within a period of one month from today and if the amount is deposited as mentioned above, thereafter the petitioner shall move an application for compouding/dropping the proceedings pending against him before the concerned authority below within a period of 15 days, the same shall be considered and disposed of within a period of 15 days thereafter.
For a period of two months from today or till the disposal of the aforesaid application whichever is earlier no coercive action shall be taken against the petitioner in the aforesaid case.
In case, the petitioner does not deposit the amount as stipulated above, the protection granted by this Court shall automatically stands vacated.
