Shri Pankaj Kumar Shukla, learned counsel appears for the respondent nos. 3, 4 and 5. Learned Standing Counsel appears on behalf of the respondent nos. 1 and 2.
Sole ground of the petitioners is that the respondent no. 4 is installing electrical poles over his bhumidhari plot without taking his consent.
Learned counsel for the respondents, on the other hand, stated that the respondents concerned are entitled to erection/fixing of pole for installing transmissions light for conducting electricity. He further states that under the provisions of Rule 3 of the Works of Licensees Rules, 2006, the District Magistrate or the Commissioner of Police or the authorized officer is empowered to take steps after considering the objections/representation made by the persons, who are owners or occupier of the land.
Accordingly, in view of the statement made by learned counsel for the respondents, the writ petition is disposed of with a direction that in case, an appropriate representation is filed by the petitioners before the authority concerned, he shall consider the same in accordance with law expeditiously.
