As it has been alleged that the order dated 19.4.2019 passed in Writ A No. 6088 of 2019 is not being complied with by the opposite party.
While disposing of the aforementioned writ petition, the direction was issued to the Senior Superintendent of Police, Mathura to consider and decide the representation of the petitioner by a reasoned and speaking order, expeditiously, preferably within a period of three months.
Sri Piyush Shukla, learned Standing Counsel apprised to the Court that so far as the promotion from the post of Constable to Sub Inspector is concerned, the same is governed by U.P. Sub- Inspector and Inspector (Civil Police) Service Rules, 2015.
In such a situation, no useful purpose would be served in keeping the present contempt application pending consideration and with the consent of the parties, the same stands disposed of asking the Senior Superintendent of Police, Matura/opposite party to proceed strictly, in accordance with law and in case the credentials of the applicant are in order definitely the matter may be referred to the U.P. Police Recruitment and Promotional Board, Lucknow for consideration. It is also expected that the Board will proceed on the same strictly, in accordance with law and in view of the aforementioned Rule, expeditiously within a reasonable time.
