Heard counsel for the petitioner and learned Standing Counsel. Writ petition is being filed for the following relief:
"issue a writ, order or direction in the nature of mandamus commanding the Collector, Bhadohi (Respondent no. 1) to make the enquiry of allotment of Gaon Sabha land and take the decision within certain period about illegal allotment of respondent No. 3 on the basis of application moved by the petitioner Under Section 122-c(6) of U.P. Zamidari Abolition and Land Reforms Act, 1950."
The document of alleged allotment which has been filed along with writ petition as annexure-1, is a mere recommendation. Despite repeated query by the Court, counsel for the petitioner has not been able to show that the recommendation aforesaid made on 15.3.2000 was ever approved by the competent authority.
In the absence of the same, there is no allotment and, therefore, no question of its cancellation arises.
Under the circumstances the writ petition is entirely misconceived and is rejected.
