Review Application No.1721 of 2013.
Heard.
It is stated that in spite of the best effort, the petitioner could not get the document which indicates that the institution receives the grant-in-aid. A copy of the said document has been brought on record, which indicates that the petitioner's institution receives financial aid. The petitioner has brought on record an order dated 22.03.1973 and a list of the Sanskrit schools, which get the financial aid from the State Government. In the said list, the petitioner's institution figures at serial number 14. In my view, the said document is a material document. This Court in its order dated 10.12.2012 has recorded that the institution was not receiving any aid from the State Government.
It is also stated that in the judgment dated 10.12.2012, the Court has not considered the judgement of the Supreme Court in the case of Anadi Mukta Sadguru Shree Mukta Jee Vanda Swami Suvarna Jayanti Mahotsav Smarak Trust & Ors Vs. V.R. Rudani & Ors. (1989) 2 SCC 691.
The review application is allowed and the order dated 10.12.2012 is recalled and the writ petition is restored to its original number.
The explanation submitted by the office is seen. No further order is required to be passed.
Office report dated 24.05.2016 indicates that in compliance of the order dated 22.04.2016, service report is that neither acknowledgement nor unserved notice has been received in the office as yet.
In view of the office report dated 24.05.2016, the service on the respondent is deemed to be sufficient.
Respondents are directed to file counter affidavit.
