Heard learned counsel for the appellant.
The appellant is due to attain his superannuation within 10 months from now. He has sought re-transfer in the adjoining district to his home district and it is for this reason he filed the writ petition giving rise to the present aspect. The learned Single Judge has declined to interfere on the ground that transfer being a matter of policy, the writ petition did not call for any interference.
There is no doubt about the aforesaid proposition of law but in view of the personal difficulty as expressed by the appellant through a representation by his spouse, in our opinion, it would be appropriate that the request be considered by the respondent no.1 and an appropriate order be passed on the representation of the appellant keeping in view the need of the department and also the inconvenience shown by the appellant, expeditiously preferably within two months.
The appeal is disposed off with the said observations.
