Heard learned counsel for the petitioner and learned Standing Counsel.
The counsel for the petitioner has filed the present petition seeking a direction for payment of retiral dues. It has been stated that the petitioner was appointed on 1.7.1979 and after 25 years in service was regularized on 8.9.2004. The petitioner had retired on 31.7.2014 and despite sufficient time having passed is not been paid his pension and retirement benefits.
Needless to say that the question of the payment of pension ought to have been decided within a reasonable time. However the petitioner not been paid pension and retirement benefit for such a long time cannot be sustained nor justified in any manner.
The counsel for the petitioner should filed a detailed representation before the respondent No. 4 who will take a decision thereon positively within a period of 3 weeks from the date of receipt of the representation and a certified copy of this order and shall communicate the same to the petitioner and if the petitioner is found to be eligible for pension, the same shall be paid expeditiously within a period of 3 weeks thereafter.
With the above direction the writ petition is disposed off.
