Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The application filed by the petitioner for issuance of caste certificate was rejected by Tehsildar, Sadar, Agra and information in this regard was communicated to the petitioner online on 27.05.2019. The petitioner is stated to have filed an application before District Magistrate challenging the order of rejection. The said application is pending.
The petitioner has prayed for a mandamus directing respondent no. 2 to decide the matter and issue caste certificate to him.
Learned Standing Counsel points out that the petitioner has remedy of filing appeal under Section 6 of the U.P. Janhit Guarantee Adhiniyam, 2011. He submitted that the appellate authority would be the Sub Divisional Magistrate, respondent no. 3.
Counsel for the petitioner states that the petitioner had also filed application on 31.07.2019 before Sub Divisional Magistrate.
Accordingly, we dispose of the writ petition with liberty to the petitioner to approach respondent No. 3 with a photocopy of application dated 31.07.2019 and true attested copy of the instant order, in which event, the third respondent shall take decision, in accordance with law, expeditiously, but not later than twelve weeks.
