While entertaining the writ petition this Court passed following order in the matter on 10.02.2021:-
"The present writ petition has been filed with the grievance that petitioner who retired as Assistant Teacher on 30.06.2019 is not being paid his post retiral dues including his G.P.F. amount.
Learned Standing Counsel representing the respondent no.4 prays for and is granted 10 days' time to seek instructions in the matter.
Put up again as fresh on 25.02.2021."
Again when the matter was taken up next on 08.07.2021, following orders were passed:-
"Grievance is that though petitioner had retired more than two years back, but without any justification, the amount of GPF alongwith interest has not been paid to him.
This writ petition was filed in January and a period of more than six months has expired.
Learned Standing Counsel states that he requires two weeks' further time in the matter as the records are not traceable.
As a last indulgence, two weeks and no more time is allowed to the learned Standing Counsel to obtain complete instructions in the matter.
Post this matter as fresh, once again, before the appropriate Court on 27.7.2021."
Learned Standing Counsel has obtained instructions from District Inspector of Schools, Moradabad, which are taken on record. As per the instructions a sum of Rs. 17,38,320/- has been paid to the petitioner.
Learned counsel for the petitioner, however, states that the amount of interest has not been paid and only the principal amount has been paid.
In the facts of the present case it would be appropriate to direct the third respondent to furnish details of the heads under which the amount has been paid to petitioner within four weeks from the date of presentation of a copy of this order. Petitioner, if aggrieved, may represent against it and the third respondent shall pass a fresh order after considering such representation within a further period of two months, thereafter. Right of the parties would be governed, accordingly.
Subject to the above directions/observations this petition is disposed of.
