ORDER ON THE CRIMINAL MISC. BAIL APPLICATION This is a bail application moved on behalf of applicant namely Ramesh Chand in ST No. 629 of 2008 connected with S.T. No. 928 of 2009 arising out of case Crime No. 101/2007, under Section 304-B of IPC and under Section 3/4 of D.P. Act, PS Kyolaria, District Bareilly.
Heard learned counsel for the applicant and learned A. G. A. for the State.
Learned counsel for the applicant has strongly pressed the bail application with the contention that applicant Ramesh Chand is husband of the deceased and he is jail since 19.04.2007. However, the fact remains that the incident is said to have taken place during night time when the presence of the husband cannot be doubted. The cause of death of the wife of applicant is strangulation. Thus, no case for grant of any indulgence is made out.
Accordingly, the application for bail is rejected.
However, keeping in view the fact that applicant is in jail since 11.10.2014, the hearing of the appeal is expedited under Chapter-VIII Rule 33A of the Rules of Court.
Let the paper book be prepared within two months from today and thereafter appeal be listed for hearing before appropriate Bench.
