Heard Shri Prashant Shukla, learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State respondent nos.1 to 3.
The petitioner, who is presently senior-most Lecturer (English) in Fateh Chandra Inter College, Tita Ka Tal, Loha Mandi, Agra, is before this Court with request to issue direction commanding the District Inspector of Schools, Agra to hand over the charge of officiating Principal of the institution in question being senior-most eligible teacher in the institution.
Learned counsel for the petitioner in support of his submission has placed reliance on the order dated 20.9.2014 passed by the District Inspector of Schools, Agra (Annexure-17 to the writ petition) whereby inter-se seniority between the petitioner as well as Shri Yogendra Singh Indauliya, who has been arrayed as respondent no.5 to the writ petition, has been finalized and at no point of time, the said order has been assailed and the same has attained finality. The request has been made for direction to the District Inspector of Schools, Agra to decide the claim of the parties in the light of the aforesaid order dated 20.9.2014.
Learned Additional Chief Standing Counsel for the State respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the Joint Director of Education, Agra Region, Agra to look into the grievance of the petitioner and decide the same strictly in accordance with law after taking necessary comments from the Committee of Management of the institution in question, as well as respondent nos. 5 and 6 within a period of two months from the date of production of a certified copy of this order before him.
