Supplementary affidavit filed today is taken on record.
Heard Shri Birendra Kaushik, learned counsel for the petitioner, learned standing counsel for the respondent no.1 and Shri Shiv Nath Singh, learned counsel for the respondent no.2.
The petitioner in the writ petition is seeking a direction to the respondents to pay gratuity and other post retiral benefits.
The averment of paragraph 7 of the writ petition shows that the petitioner was out of service from 17.08.1998 to 31.01.2015 (16 years). His representation at pages 18 to 20 of the writ petition shows that he has not been paid gratuity for the period from 17.08.1998 to 31.01.2015 but the rest of the gratuity has already been paid to him.
Shri Shiv Nath Singh, learned counsel for the respondents states that gratuity for the period from 17.08.1998 to 31.01.2015 is pending consideration.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.2, Secretary/Chief Executive Officer, Agra District Co-operative Bank, Agra to take a decision in the matter in accordance with law expeditiously preferably within a period of one month from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
