Sri Amit Mahohar Sahai, learned counsel appearing for the respondent nos.2 and 3 raised objection that the writ petition is not maintainable as against the impugned order an appeal lies under sub Section (2) of Section 27 of U.P. Urban Planning Development Act, 1973.
We find the submission of learned counsel for the respondents merits acceptance.
Accordingly writ petition is disposed of leaving it open to the petitioner to take recourse to such remedy which is available under the law. In case the petitioner files an appeal within two weeks, the same shall be considered on merits and shall not be rejected on the ground of the limitation.
