Heard learned counsel for the applicant and learned A.G.A. for the State.
It is submitted by learned counsel for the applicant that the present matter relates to offence under Section 138 of N.I. Act between the parties and the said matter can be well considered by Mediation Centre of this Court.
It is directed that applicants shall deposit a sum of Rs.10,000/- within two weeks' from today with the Mediation Centre of which 90% shall be paid to opposite party no.2 for her appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that the Mediation Centre shall conclude the mediation and conciliation proceedings expeditiously, preferably within a period of one month after giving notices to both the parties.
Thereafter the case shall be listed before appropriate Bench.
Till the next date of listing, operation of the impugned order dated 01.05.2019 passed by C.J.M. Allahabad in complaint Case No.313 of 2011, under Section 138 N.I. Act, P.S. Shivkuti, District Allahabad, pending in the court of C.J.M. Allahabad shall remain stayed.
After depositing the amount, aforesaid, notices shall be issued to the parties and in case the aforesaid amount is not deposited within the aforesaid period, this application shall stand dismissed automatically.
