Learned advocate for the applicant who apprehends danger and threat to his life and also to his family members and according to him the accused and other persons are highly influential and against whom various criming cases are pending. However, the trial Court continues to proceed with the trial, in the above circumstances, it is submitted that the trial be stay and necessary protection be provided.
If the applicant in fact apprehends danger from the accused of the Sessions Case No. 95 of 2010 or from any other persons it is open for the applicant to appraise the trial Court and order will be passed in accordance with law but at the time the proceedings cannot be stayed only on apprehension.
The application in the above circumstances is rejected.
