The grievance of the petitioners is regarding payment of salary of the post of Assistant Teachers in Junior Basic School/Head Master in the Primary Schools.
The petitioners are demanding pay-band of Rs. 9300-34800/- with grade pay of Rs. 4600/- minimum pay scale of Rs. 17,140/- from the date they have been promoted as Assistant Teacher/Head Master in Senior Basic School (Junior High School) and Head Master in Junior Basic School (primary school) with all consequential benefits.
The submission of Sri R.K. Ojha, Senior Counsel appearing for the petitioners is that this controversy has already been resolved by the Delhi High Court which judgment and order has been affirmed by the Hon'ble Supreme Court as well.
The matter of payment of salary admissible to the petitioners can be resolved in the light of the aforesaid decisions or any other decision on the point by the Principal Secretary/Additional Chief Secretary, Basic Education, U.P., Lucknow (respondent No.1).
In view of the aforesaid facts and circumstances, we dispose of this petition with liberty to the petitioner to raise their grievance by means of a comprehensive representation before the respondent No.1 within a period of 2 weeks from today. On the grievance so raised, the respondent No.1 shall consider the same in the light of the above decisions or any other decision or contrary decision on the point in accordance with law most expeditiously, if possible, within 2 months from the date of the receipt of the representation.
