Heard learned counsel for the petitioner and learned Standing Counsel for the respondents no. 1 to 4.
The petitioner is seeking old age pension under the Old Age Pension Scheme of the State of Uttar Pradesh started in the year 2016.
A bare perusal of some of the terms and conditions of the aforesaid scheme reveals that residents of Uttar Pradesh who are over 60 years of age and who are not able to earn anything alone are entitled to old age pension. Citizens above 80 years of age are entitled to Rs.500/- per month and those who are 60 - 79 years are entitled to Rs.300/- per month, out of which Rs.100/- shall be paid by the State Government and the remaining Rs.200/- by the Central Government.
The averments made in the writ petition nowhere discloses as to when the petitioner applied for the benefit of the said Old Age Pension Scheme. There are no pleadings to the effect that apart from the age of 70 years, the petitioner is otherwise eligible for the old age pension as there is no averment that he is unable to earn his livelihood.
The entire emphasis of the petitioner is regarding misappropriation of the pension fund by the officers and for an inquiry into the matter of disbursement of pension to non-eligible persons.
In the facts and circumstances of the case, we do not find that the petitioner has really any grievance regarding non-payment of the old age pension to him.
Accordingly, we do not consider it necessary to exercise our discretion in favour of the petitioner and the writ petition is dismissed.
