By order dated 08.01.2019, the application 88-C filed by the defendant-petitioner showing willingness to deposit one day salary of the process server Laxmi Ram in Court to enable the Court to summon him, has been rejected by the trial court. By order dated 26.03.2019, the application 92-C filed by the defendant-petitioner for recall of order dated 08.01.2019 has been rejected.
In considered opinion of the court, the orders impugned are purely interlocutory in nature and do not warrant scrutiny at this stage in exercise of power under Article 227 of the Constitution.
Counsel for the petitioner submitted that it may be left open to the petitioner to challenge the impugned orders along with the final order which is passed in the suit.
Accordingly, the instant petition is disposed of with liberty reserved in favour of the petitioner to challenge the impugned orders along with the final order which is ultimately passed in the suit.
