Order dated 10th April, 2018 is challenged in this petition, which provides as under:-
(i) Petitioner is awarded an adverse entry;
(ii) Question of release of salary during the period petitioner remained under suspension would be considered after examining the petitioner's explanation.
So far as the first part of the order is concerned, learned counsel for the petitioner submits that petitioner has the remedy of preferring an appeal, and that it would be challenged before the appellate authority. So far as the second part of the order is concerned, petitioner submits that he has already submitted his explanation, but no decision has been taken on the question relating to release of salary during the period petitioner remained under suspension. Submission is that the authorities be directed to consider the question of release of salary.
Learned Standing Counsel submits that in case petitioner has submitted his explanation, the same shall be considered, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of with the observation that in case petitioner submits a copy of his explanation already submitted before the authority, alongwith certified copy of this order, within two weeks from today, the same shall be examined by the authority concerned, in accordance with law, by means of a reasoned order, within a further period of two months, thereafter.
