Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondents.
The petitioner has preferred the present petition inter-alia with the following prayers:-
"i. Issue a writ, order or direction in the nature of mandamus directing the respondents to make the payment of General Provident Fund (GPF) amount of Rs.438535/- the petitioner's husband;
ii. issue a writ, order or direction in the nature of mandamus directing the respondents to make the payment of interest on the delayed payment of General Provident Fund (GPF) since the date of retirement to till date actual payment, as the respondents are solely responsible in delaying the payment of G.P.F."
It is argued by learned counsel for the petitioner the husband of the petitioner namely late Shiv Shankar Sharma was appointed as Class IV employee in Jawahar Lal Nehru P.G. College, Etah on 01.11.1977. He retired on 31.12.2017 working on the aforesaid post. Subsequently, he died on 01.08.2018. It is argued that after the retirement of the husband of the petitioner, papers were regarding payment of G.P.F. was submitted by the Institution before respondent No.5 but till date no action whatsoever has been taken on the same.
In the facts and circumstances of the case but without entering into merits of the case, the present petition is disposed of directing the respondent No.5 to pass appropriate orders on the papers and documents submitted by the Institution regarding payment of G.P.F. and other post retiral benefits most expeditiously and preferably within a period of two month from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad.
