Heard learned counsel for the petitioner; learned AGA for respondents 1, 2 and 3; and perused the record.
The instant petition is at the instance of the accused who is aggrieved by long pendency of the investigation of case crime no.531 of 2018, under Section 3/7 of Essential Commodities Act, police station Ajeetmal, District Auraiya.
It has been submitted that because of pendency of the investigation, civil rights of the petitioner are affected as he is a fair price shop dealer. It is thus the prayer of the petitioner that a direction be issued to the Investigation Officer to conclude the investigation.
Considering the nature of the prayer made, we deem it appropriate to dispose off the petition by providing that if the investigation has not yet been concluded, the second respondent (Superintendent of Police, Auraiya) shall ensure that the investigation of the case is concluded within a period of two months from the date of production of certified copy of this order.
With the aforesaid direction, the petition stands disposed off.
