Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed with a prayer to direct the learned Additional Chief Judicial Magistrate IInd, Jaunpur to decide the Case No. 971 of 2015 (State Vs. Rana Singh and others), arising out of Case Crime No. 75-A of 1996, under Sections 323, 504, 324, 506 IPC, Police Station Jalalpur, District Jaunpur within stipulated period.
Learned counsel for the applicant has submitted that applicant is the first informant of the present case, which is pending since 1996 and in the said case, statements of PW-1 and PW-2 have already been recorded and the trial has been lingering-on, on one pretext or the other.
In view of the above, learned court below is directed to make all endeavours to decide the aforesaid case, as expeditiously as possible, preferably within a period of eight months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
