Heard Shri Ram Samujh Singh, learned counsel for the petitioner, Shri Gyanendra Srivastava, learned standing counsel for respondent nos. 1, 2, 3 & 4 and Shri Aalok Kumar Srivastava, learned counsel for respondent no. 5.
On 23.04.2019, we had directed the learned standing counsel to obtain instructions in the matter as to why the earlier order of 01.04.2010 was not being complied with by the respondent no. 3.
Learned standing counsel, on instructions received, informs that against the order of 01.04.2010, the respondent no. 4 had filed a recall application and after hearing the parties, the order of 01.04.2010 has been recalled by order dated 25.04.2019 and the matter has been fixed for disposal on 30.05.2019.
We, therefore, dispose of this writ petition with a direction to the Niyat Pradhikari, Viniyamit Region/Up-Ziladhikari, Deoria (the respondent no. 3) to decide the matter, regarding plot no. 168 situated in Maharana Pratap Nagar, Bhujauli, District - Deoria, expeditiously, preferably, within a period of two months from the date of receipt of a certified copy of this order in his Office.
The instructions are kept on record.
