Heard learned counsel for the petitioner; the learned Standing Counsel for the State-respondents 1 to 3; and perused the record.
The petitioner claims herself to be Bhumidhar of plot no. 1068 area 0.197 hectare at village Parsauni Khurd Ward No. 11, Maulana Ajad Nagar, Nagar Palika Parishad, Nautanwa Tappa, Marchwar, Pargana Vinayakpur, Tehsil Nautanwa, District Maharajganj.
According to the petitioner, she wishes to transfer her property by way of gift in favour of respondent no.4 for which permission has been sought from the District Magistrate, Maharajganj under Section 98 of the U.P. Revenue Code, 2006 on which no decision has yet been taken.
The prayer in this petition is that a direction be issued to the District Magistrate, Maharajganj to take a decision on the aforesaid request of the petitioner and grant permission for execution of such gift-deed.
Considering the nature of the prayer made, we deem it appropriate to dispose off this petition by providing that the District Magistrate, Maharajganj shall take a decision on the request of the petitioner within a period of four weeks from the date of filing of copy of this order along with copy of the application seeking permission.
It is made clear that we have not expressed any opinion on the merits of the claim of the petitioner.
