Heard learned counsel for the petitioner and learned Standing Counsel for State.
Present writ petition has been filed to issue a writ, order or direction in the nature of mandamus directing to respondent Nos. 5 and 6 to recover Rs. 3,92,763/- from respondent Nos. 2, 3 & 4 and pay the same to the petitioner pursuant to an order or recovery dated 30.01.2020 passed by Deputy Labour Commissioner, Gorakhpur, U.P.
This Court vide order dated 15.07.2021, directed learned Standing Counsel to seek instruction. As per instruction, entire amount in dispute i.e. Rs. 3,92,763/- has been deposited by the Treasury Officer, Kushinagar into the account of Deputy Labour Commissioner, Gorakhpur, U.P. Now it is open for the petitioner to get the amount released in his favour in accordance with law for which learned counsel for the petitioner has no objection.
Therefore, in the light of aforesaid development, writ petition rendered infructuous and is accordingly, dismissed as infructuous.
No order as to costs.
