Heard Sri Ram Chandra Kushwaha, learned counsel for the petitioner and learned Standing Counsel for respondent no. 1. Notice need not to be issued to respondent no. 2, at this stage.
This writ petition has been filed with the following prayer:-
" I. Issue a writ order or direction in the nature of mandamus directing/commanding to the respondent no. 1 i.e. Sub Divisional Officer Salempur, Tehsil- Salempur District Deoria to decide the Partition Suit No. 04457 of 2019 (Computerized Case No. T201905200204457) Gaurishankar vs. Ramashish and other under Section 116 of U.P. Revenue Code, 2006 within stipulated period."
It is contended that the proceedings under Section 116 of the U.P. Revenue Code, 2006 is pending consideration before respondent no. 1. The sole prayer is for early disposal of the proceedings.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 1 to conclude the proceedings pending before him, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
