Heard Sri Manoj Kumar Singh, learned counsel for the petitioner and Sri Abhishek Shukla, learned Standing Counsel for the State-Respondent.
Petitioner is before this Court asking the Respondent authority to remove the illegal encroachment of Respondent No.5 to 7 situated at Gata No. 228 situated at village Parsia Rooppur, Pargana Sikandarpur Garvi, Tehsil Belthara Road, District Ballia in pursuance to the order dated 11.8.2017 passed by the Tehsildar/Assistant Collector-I, Tehsil Belthara Road, District Ballia in Case No. 23 of 2013 under Section 122B of U.P.Z.A.&L.R. Act.
Learned counsel for the petitioner states that the aforesaid proceeding has been finalized against the private respondent but in response, respondents are not taking any action and at no point of time said order has been implemented.
In the facts and circumstances without adverting on the merits of the case, with the consent of the parties, the writ petition stands disposed of asking Sub Divisional Magistrate, 3rd Respondent to look into the grievance of the petitioner and pass an appropriate order but certainly after giving an opportunity of hearing to the private respondent, in case there is no legal impediment.
