Heard learned counsel for the parties.
Petitioner retired from the post of Deputy Excise Inspector on 31 May 2016 on attaining the age of superannuation.
By the instant petition, petitioner seeks the following relief:
"i) issue a writ, order or direction in the nature of mandamus commanding the respondents to ensure payment of amount of GPF, gratuity, leave encashment, arrears of pay band etc. forthwith."
Learned Standing Counsel submits that the second respondent shall pass appropriate order on the representation of the petitioner in accordance with law.
In view thereof, on consent, the petition is disposed of directing the second respondent, Excise Commissioner, Uttar Pradesh, Prayagraj, to consider and decide the representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within two months from the date of filing of certified copy of this order along with the copy of the writ petition, failing which, the petitioner shall be entitled to interest at the rate of 6.5% on the entire sum from the due date.
It is clarified that the Court has not considered the claim of the petitioner on merits.
