This petition has been filed for a direction upon respondents to decide petitioner's revision allegedly filed on 16th November, 2016, under Rule 29 of the C.R.P.F. Rules, 1955.
While entertaining the writ petition, time was allowed to Shri Narendra Singh, learned counsel for the respondents, to obtain instructions. Learned Standing Counsel, on the basis of instructions, states that the petitioner's revision has not been received in the office of the concerned respondent, till date. It is also stated that C.R.P.F. Rules, 1955, do not apply in the present case, inasmuch as, the petitioner is an employee of Central Industrial Security Force.
The petitioner has brought on record the alleged revision filed by him as Annexure-4 to the writ petition. Postal receipt dated 16.11.2016 is also annexed.
In such circumstances, in case the revision has not been received, it would be appropriate to permit the petitioner to file appropriate revision before the authority concerned within a period of two weeks from today. In case, such a revision is filed before the concerned authority, the same shall be considered in accordance with law.
This observation is being made considering the fact that under the C.I.S.F. Rules, 1959, also a provision for filing the revision exists.
Subjection to the observation above, the writ petition stands disposed of.
