JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)
1. The present application is filed by the convict through his brother seeking temporary bail for a period of 30 days so as to undertake repairs of his house.
2. RULE.
Mr.L. R. Poojari, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
3. In support of the application, a certificate from the Sarpanch, Group Gram Panchayat, Jalia, Taluka - Idar, District - Sabarkantha. and the photograph's of the house are annexed.
4. Learned APP made available for perusal the jail remarks. The convict is undergoing life imprisonment for offence under Section 302 of the Indian Penal Code as well as section 135 of the Bombay Police Act in Sessions Case No.33 of 2010, wherein he was convicted by judgment and order dated 21.07.2011.
5. As on 16.07.2012, the convict has undergone two years, seven months and twenty days. He has enjoyed one furlough and has reported in time. Nothing adverse is reported against him in the jail remarks.
6. For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 30 (thirty) days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
7. The convict shall surrender to the Jail authorities on expiry of the temporary bail period.
8. Rule is made absolute.
Direct service is permitted.
