The defeated defendant in O.S.No.575 of 2007 on the file of the Principal Sub Court, Thrissur, is the appellant. O.S.No.575 of 2007 is a suit for specific performance. The dispute between the parties in this appeal is compromised and I.A.No.2443 of 2014 is filed to record the compromise. In view of the compromise arrived at between the parties, we set aside the decree and judgment impugned in this appeal and dispose of the suit, O.S.No.575 of 2007 in accordance with the terms of the compromise. A copy of the compromise petition shall be appended to this judgment.
2. In view of the provision contained in Section 69 of the Kerala Court Fees and Suits Valuation Act, the appellant is RFA 659 of 2011 2 entitled to refund of one half of the court fee paid in this appeal.
