JUDGMENT / ORDER

Rule.
Learned counsel, Shri Satyam Chhaya, who appears on caveat, waives service of notice of rule for respondent no.1.
In view of the contentions raised by learned counsel, Shri Mehul S. Shah for the applicant and learned counsel, Shri Satyam Chhaya, who appears on caveat for the respondent no.1 and having perused the papers and also the judgment of the Hon ble Apex Court in Civil Appeal No.2553/2012 arising from SLP ¿ No.6025 of 2010 between the same parties dated 27.02.2012, interim relief is required to be granted.
It is clarified that interim relief in terms of Para No.5(a) is granted subject to conditions to be fulfilled by both sides as recorded in the order of the Hon ble Apex Court in Civil Appeal No.2553/2012 arising from SLP ¿ No.6025 of 2010 dated 27.02.2012.
In view of above, present Civil Application stands allowed accordingly. Rule is made absolute to the aforesaid extent.
