Shri Sushil Kumar Rao, learned counsel for the petitioner submits that the petitioner is Senior citizen and plaintiff in Original Suit No.2106 of 2012 (Ramanand and another vs. Subhash and others). He fairly submits that though vide order dated 21.11.2012, passed in the aforesaid mentioned suit, a temporary injunction has been granted in his favour which is continued till date. However, as a bona fide litigant, he has approached before this Court as the suit is lingering of at the stage of framing of issues.
Considered the submissions made at Bar and perused the record.
In the light of the judment passed by the Hon'ble Supreme Court in the matter of M/s Shiv Cotex vs. Tirgun Auto Plast P. Ltd and Others 2011 (89) ALR, 232, this writ petition is disposed of with the direction to learned court below to decide the aforesaid suit while taking all endeavours, expeditiously, preferably within a period of one year from the date of production of certified copy of this order, without granting any unnecessary adjournment to either of the parties
