Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed to quash the charge sheet dated 27.01.2019 as well as order dated 13.03.2019 passed by learned Additional Sessions Judge, Ist, Ballia in S.T No.160 of 2019, State Vs. Ramanand Chauhan in case crime no.151 of 2018, under Sections 363, 366, 376 IPC and Section 3/4 POCSO Act, Police Station- Bhimpura, District-Ballia, pending before the court of Additional District and Sessions Judge, Court No.1, Ballia.
The contention advanced by learned counsel for the applicant is that the applicant has been bailed out in the above-mentioned case.
Since the applicant has already been bailed out, the remedy provided to the applicant is that if the applicant moves an application for discharge raising all the objections which have been taken by him in this application, the same shall be decided by the court concerned by well reasoned order strictly in accordance with law.
With the aforesaid observations, the present application stands disposed of.
