JUDGMENT / ORDER

When the matter came up for hearing on 21.02.2017, the learned counsel for the appellant reported no instructions from his client and hence, this Court directed the Registry to print the name of the appellant in the cause list and list the matter today i.e. 23.02.2017. Accordingly, the name of the appellant has been printed in today's cause list. At about 11.30 a.m., when the matter was taken up for hearing, there was no representation for the appellant. However, it was passed over and at about 12.30 p.m., when the matter was taken up for hearing, again there was no representation for him. In such circumstances, this Court has no other option except to dismiss the second appeal for non-prosecution.
2. Accordingly, the second appeal is dismissed for non-prosecution. No costs. Consequently, connected miscellaneous petitions are closed.
