JUDGMENT / ORDER

This Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the second respondent to consider the petitioner's representation, dated 14.07.2009 and in consequence thereof, directing the first respondent to pay the deficit charges to the petitioner, after proper measurement.
2. Mr.S.C.Herold Singh, the learned Government Advocate takes notice on behalf of the respondents 1 and 2 and with the consent of both parties, the writ Petition is taken up for final disposal.
3. The learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if the second respondent is directed to dispose of the representation of the petitioner, dated 14.07.2009, on merits, and in accordance with law, within a specified period fixed by this Court.
4. Mr.S.C.Herold Singh, the learned Government Advocate, appearing on behalf of the first and the second respondents, did not have any objection for such an order being passed by this Court.
5. In view of the submissions made by the learned counsels appearing on either side, without going into the merits of the case, the second respondent is directed to dispose of the representation of the petitioner, dated 14.07.2009, on merits, and in accordance with law, within a period of eight weeks, from the date of receipt of a copy of this order.The Petitioner is directed to enclose a copy of the representation, dated 14.07.2009, along with a copy of this order, to the second respondent
6. With the above directions, the Writ Petition is disposed of. No costs.
