JUSTICE R.MAHADEVAN Writ Petition No.4042 of 2017 Writ petition has been filed under Article 226 of the Constitution of India, praying for a Writ of mandamus directing the Respondent to grant permission and protection to conduct Orchestra Program (Light Music Program) in the Sri Nagamman Temple situated at Pillaiyar Agraharam Village, Koppakarai Post, Thenkanikottai Taluk, Krishnagiri District, Scheduled to be held on 22.02.2017 to 25.02.2017 at 7.00 p.m to 10.00 p.m For Petitioner : Mr.D.Ramesh Kumar For Respondent : Mr.Sanjay Gandhi, Addl. Govt. Pleader ORDER By consent, the main writ petition itself is taken up for final disposal.

The petitioner has come up with the present writ petition for a mandamus, directing the respondent to grant permission and protection to conduct Orchestra Program (Light Music Program) in Sri Nagamman Temple situated at Pillaiyar Agraharam Village, Koppakarai Post, Thenkanikottai Taluk, Krishnagiri District, Scheduled to be held on 22.2.2017 to 25.2.2017 at 7.00 p.m to 10.00 p.m.

Learned counsel appearing for the petitioner submitted that the petitioner and the villagers of Thenkanikottai Taluk, Krishnagiri District, have been conducting festival in Sri Nagamman Temple every year. This year also, they have decided to conduct the festival. However, this year, the police officials are insisting their permission for conducting cultural events especially orchestra program as a part of celebrations. Hence, the petitioner submitted a representation dated 1.2.2017 to the respondent seeking permission to conduct the light music program. However, the respondent police has not given permission to conduct the program. Hence, the petition.

Today, when the matter was taken up for consideration, learned Additional Government Pleader submitted that under the pretext of conducting temple festival, there is every possibility of conducting obscene dances. Further, he has submitted that if the petitioner undertakes that they would conduct only light music program and not Adal Padal program or any other obscene dances, necessary permission would be granted by the respondent police. Learned counsel appearing for the petitioner has also submitted that they will conduct only light music program and they will not conduct any Adal Padal program or any other obscene dances during the festival.

The said submission made by the learned counsel appearing for the petitioner is hereby recorded and the respondent police is directed to provide adequate police protection for conducting the temple festival of Sri Nagamman Temple situated at Pillaiyar Agraharam Village, Koppakarai Post, Thenkanikottai Taluk, Krishnagiri District, Scheduled to be held on 22.2.2017 to 25.2.2017 at 7.00 p.m to 10.00 p.m. However, it is open to the respondent police to take appropriate action, if there is any violation of the said undertaking given by the learned counsel appearing for the petitioner. The writ petition is disposed of accordingly. No costs.
