Heard Sri Rajesh Kumar Dubey, learned counsel for the petitioner, learned Standing Counsel for respondent no. 1 and Sri Sudhir Bharti, learned counsel for respondent no. 2. Notice need not to be issued to respondent no. 3 to 7, at this stage.
This writ petition has been filed with the following prayer:-
" A- Issue a writ order or direction in the nature of mandamus commanding the respondent no. 1 to set-aside the report dated 08.11.2020 i.e. submitted by the Revenue Inspector, pertaining to Gata no. 32/1, measuring its area 0.039 Hectares, situated in village Basdev Chak, Tappa-Sadhiyaon, Pargana-Salempur Majhauli, Tehsil- Salempur, District- Deoria.
B- Issue a writ order or direction in the nature of mandamus commanding the respondent no. 1 to expedite the proceedings of case no. "T-201905200205065"- Ramakant vs. Laxmi Narayan, under Section 24 of U.P.Z.A. and L.R. Act, village Basdev Chak, Tappa-Sadhiyaon, Pargana-Salempur Majhauli, Tehsil- Salempur, District- Deoria, forthwith, or within a time as stipulated this Hon'ble Court."
Learned counsel for the petitioner states that he is not pressing prayer-A and his relief is confined to prayer-B only. The sole prayer is for expeditious disposal of the proceedings pending under Section 24 of the U.P. Revenue Code, 2006.
Learned Standing Counsel does not oppose the limited prayer so made for early disposal of the proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 1 to conclude the proceedings, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
