Sri R.R.Prajapadi learned counsel for the petitioner submits that the petitioner is the defendant in suit no2225 of 2000 Ram Prasad Vs Ramakant and another pending in the court of Civil Judge (JD) Deoria. He submits that at present the suit is stuck and evidence from the plaintiff side is over. However due to filing of amendment application on behalf of the plaintiff, the matter has not proceeded further. He further submits that the petitioner is a senior citizen and on the basis of submissions made above, he submits that the prayer made in the petition be allowed.
In the circumstances, the petition is disposed of with the direction to the trial court to dispose of the suit expeditiously preferably within one year from the date of production of a certified copy of this order keeping in view the judgment of the Apex Court in M/S Shiv Cotex Vs Tirgun Auto Plast P Ltd and others 2011 (89) ALR 232.
