Heard learned counsel for the petitioner; and Sri Tarun Varma for the respondents.
The petitioner had earlier approached this Court for statement of account. The previous petition of the petitioner i.e. Writ-C No.7625 of 2018 was disposed of vide order dated 26.02.2018 by giving a direction to the Bank to supply statement of account.
The petitioner has now prayed that he be permitted to deposit the amount in installments and be granted the benefit of Debt Waiver Scheme.
In so far as the prayer to permit the petitioner to deposit the amount in installment is concerned, the petitioner may approach the bank with the said request. It is expected that the bank would take an appropriate decision on the same.
As regards the benefit of Debt Waiver Scheme, it is hereby provided that if the petitioner files a comprehensive representation before the Branch Manager, within two weeks from today, enclosing therewith documents to show that the petitioner is entitled to the benefit of such Scheme, then the Branch Manager of the bank concerned shall pass an appropriate order thereon. In case the petitioner is entitled to the benefit of the scheme, then benefit may be provided to the extent permissible. But, in case the Branch Manager comes to a conclusion that the benefit is not available, then he shall record reasons while deciding the application, which shall be done, preferably, within next four weeks.
With the aforesaid observation/liberty/direction, the petition is disposed of.
