Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed for quashing the order dated 23.7.2019 passed by Special Judge (E. C. Act) / Additional Sessions Judge, Court No. 4, Ghazipur as well as order dated 19.11.2018 passed by Additional Sessions Judge, Court No. 3 in S. T. No. 172 of 2003 arising out of case crime no. 598 of 2002, U/s 147, 148, 302 IPC, P.S. Mardah, District Ghazipur.
The contention of the counsel for the applicants is that no offence against the applicant is disclosed and the present prosecution has been instituted with a malafide intention for the purposes of harassment. He further contended that the orders impugned have been passed without application of mind.
I have perused both the orders dated 23.7.2019 and 19.11.2018 which shows that trial court has thoroughly gone through the entire evidence and after due discussion of the evidence has recorded categorical findings and thus no illegality or perversity can be attributed to the orders impugned.
Moreover, learned counsel for the applicant has also failed to point out any illegality or perversity with the findings as recorded in the orders impugned, and thus no case for interference has been made out.
Accordingly, the instant application is dismissed.
