Heard Mr. D.P. Singh, learned Senior Advocate, with Mr. Rajan Tripathi, Advocate, for the petitioner and Mr. Shivam Yadav, learned counsel for respondent nos. 2 and 3 - Authority.
The only prayer made in the writ petition, reads thus:
"a) Issue a writ, order or direction in the nature of Mandamus directing the respondent authorities to permit the petitioner to erect the boundary wall on the Arazi No. 1840 area about 1003 sq. yard, in view of the measurement made by the respondent K.D.A. authority as well as the Revenue authority."
Counsel for the petitioner submits that the petitioner would be satisfied if he is allowed to approach the respondent Authority for seeking permission to erect boundary wall on his land and direction may be issued to consider and decide the same within time frame.
Petition is disposed of, as not pressed. It is open to the petitioner to approach the respondent Authority for seeking permission to construct boundary wall on his property. If such an application is made, the respondent Authority shall consider and decide the same on merits in accordance with law, within a period of four weeks from the date of its presentation.
