Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 153 of 2016, under Sections 498A, 304B IPC and Section 3/4 D.P.Act, P.S. Jhaganha, District Gorakhpur, is seeking enlargement on bail during the trial.
Supplementary affidavit filed annexing the statement of applicant who is named accused person and has been attributed the role of pouring the kerosene oil upon the deceased. The applicant is languishing in jail since 15.05.2016. By means of supplementary affidavit the applicant has submitted three witnesses has been examined, under the circumstances I am no inclined to exercise my discretion in favour of the applicant. The bail application of the applicant is hereby rejected at this stage.
However considering the peculiar facts and circumstances of the case the trial court is expected to gear up the trial and conclude the same within a period of six months from the date of production of certified copy of this order, provided the applicant renders fullest cooperation in early conclusion of the trial in the aforementioned period.
