Heard learned counsel for the petitioner and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Judge Small Causes Court, Kanpur Nagar (respondent no. 2) be directed to expedite the hearing and decide the SCC Suit No. 225 of 2009 within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Judge Small Causes Court, Kanpur Nagar (respondent no. 2) to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of nine months by giving short dates provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present petition is finally disposed of.
