Heard learned counsel for the petitioners and learned Chief Standing Counsel for the respondent nos. 1 to 3.
Petitioners claim to be working as Assistant Teachers in primary section of Dayanand Adarsh Uchchattar Madhyamik Vidyalaya, Deoria duly recognized and in grant-in-aid. By means of the present writ petition, petitioners seek the following relief :-
"to issue a writ, order of direction in the nature of mandamus directing the respondents to pay arrears of salary and future salary as and when it falls due to the teachers, who are working in the primary vidyalaya attached to Dayanand Adarsh Uchchattar Madhyamik Vidyalaya, Deoria."
Learned counsel for the petitioners has also been pointed out that in regard to similarly situated persons, orders have been passed by this Court. One such judgement has been rendered in the case of Mamta Pandey Vs. State of U.P. in Writ Petition No.4961 of 2018 by Hon'ble Mr. Justice Mahesh Chandra Tripathi on 6.2.2018.
Learned Additional Chief Standing Counsel submits that the first respondent shall pass appropriate orders as per the Government Policy.
The facts of the petitioners' case as well as the case of Mamta Pandey (supra) are similar. This petition is liable to be disposed of in the terms of the judgement of this Court in Mamta Pandey (supra).
Accordingly, without entering into the merits of the case, as well as rival contentions raised by respective parties, it is provided that the first respondent, State of U.P. through its Secretary (Secondary Education) Government of U.P., Lucknow, shall consider and redress the grievance of the petitioners by passing appropriate orders, as per Government Policy, preferably within three months from the date of production of certified copy of this order along with a fresh representation.
With the aforesaid observations/direction, the writ petition is finally disposed of.
